1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the HomePros.ie website and services (collectively, the "Platform"), operated by Configurix Limited ("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Definitions

• "Homeowner" means a user who posts a job or searches for tradespeople on the Platform.
• "Tradesperson" or "Provider" means a user who offers services and responds to job postings on the Platform.
• "User" means any person who accesses or uses the Platform, whether a Homeowner or Tradesperson.
• "Job" means a home improvement or repair project posted by a Homeowner on the Platform.
• "Lead" means an introduction or match between a Homeowner's Job and a Tradesperson.

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Platform. By using the Platform, you represent and warrant that you meet these requirements. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Platform Services

HomePros.ie acts as an intermediary platform that connects Homeowners with Tradespeople. We do not provide home improvement services ourselves, nor do we employ Tradespeople. We do not guarantee the quality, suitability, or timeliness of any services provided by Tradespeople.

For Homeowners, the Platform allows you to post jobs, browse Tradespeople profiles, and communicate with potential service providers. Job postings are free.

For Tradespeople, the Platform allows you to create a profile, browse available jobs, and receive leads. Some features may require a paid subscription or per-lead fee, as described on our pricing page.

6. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorised purpose
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Attempt to circumvent any security measures or access restrictions
• Use automated systems to access or interact with the Platform without our permission
• Post spam, duplicate content, or irrelevant material
• Impersonate any person or misrepresent your affiliation with any entity
• Interfere with the proper working of the Platform

7. Job Postings and Leads

When you post a Job as a Homeowner, you grant us a non-exclusive licence to display and share your Job details with relevant Tradespeople. You are responsible for the accuracy of the information you provide.

When you accept or purchase a Lead as a Tradesperson, you agree to contact the Homeowner in a timely and professional manner. You acknowledge that Lead fees are non-refundable except as expressly provided in these Terms.

8. Reviews and Ratings

Users may leave reviews and ratings based on their genuine experience. Reviews must be honest, accurate, and not defamatory. We reserve the right to remove reviews that violate these Terms or our content guidelines. We do not edit reviews but may moderate them for compliance.

9. Payments and Subscriptions

Certain features of the Platform require payment. All fees are quoted in Euro (EUR) and are exclusive of VAT (we are not currently VAT registered). Payment terms are as specified at the point of purchase.

Subscriptions renew automatically unless cancelled. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds will be provided for partial subscription periods unless required by law.

10. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Configurix Limited or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content without our prior written consent.

By submitting content to the Platform (such as profile information, portfolio images, or reviews), you grant us a worldwide, non-exclusive, royalty-free licence to use, display, and distribute that content in connection with the operation of the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, Configurix Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you have paid to us in the 12 months preceding the claim.

We are not responsible for disputes between Homeowners and Tradespeople, including but not limited to disputes about the quality of work, payment, or contract terms. Any such disputes must be resolved directly between the parties.

12. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may also delete your account at any time through your account settings.

Upon termination, all licences granted to you will cease, and you must stop using the Platform. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ireland.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of significant changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
